1. Provider and Scope

These Terms govern purchases and use of Omaship products and related communication.

2. Product Scope

Omaship is sold as a digital software product. Unless explicitly agreed in writing, no managed cloud hosting, server operations, or infrastructure management service is owed as part of the preorder purchase.

Website delivery, documentation, downloads, preview environments, and related security protections may rely on third-party infrastructure and network providers, including Cloudflare. Their use does not transfer contractual responsibility for the Omaship product away from Purpose Solutions.

3. Contract and Checkout Flow

Checkout is provided on a hosted Paddle page. Paddle acts as merchant of record for the transaction, including payment processing, VAT/tax handling, and invoice issuance.

Purpose Solutions remains responsible for the software product, delivery, and product-related support.

4. Pricing and Pre-order Tiers

Pre-order tiers (for example Believer, Early Founder, Launch) are sold with limited quantities where shown. Your paid order keeps the purchased price even if public pricing changes later.

5. Delivery

Pre-order access is delivered when the corresponding Omaship release is made available. Any launch timing shown on marketing pages is an estimate, not a fixed deadline.

6. Consumer Withdrawal Rights

If you are a consumer, statutory withdrawal rights under applicable law (including Sec. 312g and Sec. 355 BGB) apply.

Where digital content is delivered before the withdrawal period ends and you expressly request immediate performance while acknowledging loss of withdrawal rights, withdrawal may expire as permitted by Sec. 356 para. 5 BGB.

7. Refunds

Refund handling is described in our Refund Policy. Statutory rights remain unaffected.

8. License

Purchases grant a non-exclusive right to use the purchased Omaship version under the license terms delivered with the product.

8a. Free Tier and Landing Page Service

Omaship offers a free tier that hosts a static landing page with waitlist capture on *.omaship.app subdomains. By creating a landing page ship, you agree to the following:

• You are the data controller for any personal data (email addresses) collected through your landing page's waitlist form.
• Omaship acts as a data processor on your behalf, storing and making waitlist signups accessible to you through the dashboard.
• You are responsible for having a lawful basis to collect visitor email addresses and for informing visitors about your data practices.
• Omaship's processing of waitlist data is governed by our Data Processing Agreement.

Omaship reserves the right to remove landing pages that are used for spam, phishing, illegal content, or that violate these Terms.

9. Liability

We are liable without limitation for intent, gross negligence, and damages resulting from injury to life, body, or health.

For slight negligence, liability is limited to breaches of essential contractual obligations and to typical foreseeable damage.

Omaship is software tooling. We do not guarantee business success, revenue, conversion rates, ranking results, or fundraising outcomes.

To the extent legally permitted, liability for indirect damages, lost profits, and pure financial loss is excluded. Mandatory statutory rights remain unaffected.

10. Governing Law and Dispute Resolution

German law applies, excluding CISG, unless mandatory consumer protection law of your country of residence applies.

If you are a merchant under commercial law, exclusive venue is Köln, Germany.

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board (Sec. 36 VSBG).
